1. Object and Acceptance
These conditions regulate the access and use of the mobile application, the website, and the associated services provided by PROFITING OÜ ("Profiting"). By registering, accessing, or using the platform, the user declares to have read and fully accepted these terms, as well as the Privacy Policy and the Cookies Policy. If you do not agree with the conditions, you must not use the platform.
2. Nature of the Service
Profiting is an automated financial analysis platform based on artificial intelligence that detects market opportunities and presents them to the user in a structured way.
- The information shown is merely informative and generic.
- It does not constitute personalized financial advice, nor an individualized investment recommendation, nor an offer to buy or sell financial instruments.
- Profiting does not evaluate the suitability or convenience of the operations for the specific profile of each user.
- Profiting is not a broker, nor a bank, nor an investment services company, and is not authorized to execute client orders or to hold money or securities.
The user is solely responsible for their investment decisions and the use they make of the information provided by the platform.
3. Registration, Subscriptions, and Profiteroles
Registration can be done via Apple, Google, or email. The user is responsible for safeguarding their credentials and for all activity carried out from their account.
Profiting offers PRO (free), SUPER ($99.90), and ULTRA ($149.90) plans, which grant different levels of access to opportunities (Profits, SuperProfits, UltraProfits) and Profiteroles packages.
- Profiteroles are virtual currencies exclusive to the app, with no monetary value and not exchangeable for money, crypto-assets, or other goods outside the platform.
- They serve only to unlock premium content within Profiting and can be purchased within the application or obtained through authorized activities.
- The special content "Gold UltraProfit" requires 100 Profiteroles to unlock, regardless of the contracted plan.
Profiting may modify prices, plans, and commercial conditions, notifying the user in accordance with applicable regulations and, where appropriate, through the app itself or by email.
4. Platform Operation and Connection with External Brokers
4.1. Analysis and Identification of Opportunities
Profiting's AI tracks public sources daily (news, networks, trends, financial data, and APIs like 12data and similar ones) to classify opportunities according to their potential. Expected variations are calculated from correlations between fundamentals, market sentiment, news, and historical behavior, without constituting guaranteed predictions. Expired opportunities are marked as "closed" and shown in "Featured Profits".
4.2. Connection with External Brokers
Profiting may allow the user to connect their account at third-party brokers through:
- API integrations with read permissions (consultation of positions, orders, or account data).
- Tracking tools to show in Profiting certain information coming from the broker (executions, positions, P&L, etc.).
In any case:
- The contractual relationship regarding the securities account, the custody of money/securities, and the execution of orders is directly between the user and the external broker.
- Profiting is not part of that relationship, does not intervene in the opening of the account, nor guarantees its operation, fees, conditions, or security.
4.3. Operational Links (Deep Links) to the Broker
Profiting can generate, from a specific opportunity, deep links that directly open the interface of the broker chosen by the user with certain fields of an order pre-configured.
By way of illustration, Profiting can facilitate links that, when clicked, open in the broker:
- The symbol or ticker already selected.
- The type of order (for example, "limit").
- The direction of the operation (buy/sell).
- The amount to trade.
- The limit price or other advanced parameters.
In no case do these deep links imply that Profiting:
- Sends or executes the order itself.
- Acts on behalf of the user.
- Guarantees the execution, price, or result of the operation.
The confirmation, modification, or cancellation of the order is carried out exclusively within the broker's interface, under the user's responsibility.
4.4. Absence of Execution and Custody
Profiting, in its operating model:
- Does not send or execute buy or sell orders for financial instruments on behalf of the user.
- Does not receive, maintain, manage, or hold client funds or securities.
- Does not act as a financial intermediary, broker, discretionary portfolio manager, or personal financial advisor.
The platform is limited to analyzing data, generating and displaying opportunities, and facilitating links or interfaces that allow the user to manually transfer that information to their broker, with certain fields eventually pre-filled.
As a consequence, the user accepts that Profiting assumes no responsibility for:
- The opening or closing of orders.
- Partial or total execution.
- The price finally applied by the broker.
- Any operational or technical incident of the third-party broker.
5. Profiting Club and Ambassadors
The Profiting Club is an exclusive space for subscribers with rewards, collectibles, and merchandising.
The Profiting Ambassador program grants an EMBASSOR emblem for every 10 successful paid subscription invitations without cancellation, tracked by a progress bar or other anti-fraud control means that Profiting may implement.
The EMBASSOR emblem is exchangeable for rewards, collectibles, and variable merchandising.
Profiting reserves the right to review, limit, or cancel program benefits if it detects abuse, fraud, or uses contrary to these terms.
6. Liability and Limitations
6.1. Investment Decisions
- Profiting does not guarantee the profitability of the opportunities shown nor the accuracy, currency, or completeness of the data.
- Every investment decision corresponds exclusively to the user, who must assess it in light of their financial situation, objectives, risk tolerance, and, where appropriate, independent professional advice.
6.2. Absence of Regulated Advice
- Profiting does not provide financial, tax, legal, or any other type of advice subject to regulatory authorization.
- The platform does not perform suitability or convenience tests nor adapts opportunities to the specific profile of the user.
6.3. Technical Operation
- The platform may vary, be suspended, or updated for technical, legal, security, or service improvement reasons.
- Profiting does not guarantee uninterrupted availability of the service nor is it responsible for failures of third parties (data providers, brokers, networks, app stores, etc.).
6.4. Relationship with Third-Party Brokers
- Profiting is not responsible for the availability, conditions, commissions, order types, execution, settlement, or any other circumstance related to integrated brokers.
- Any claim regarding operations, charges, execution errors, or custody must be directed to the corresponding broker.
6.5. Measures for Non-Compliance
Failure to comply with these terms may result in the immediate suspension or cancellation of the account, without the right to a refund of ongoing subscriptions when there is fraudulent, illicit, or malicious use of the service.
7. Intellectual Property and Prohibitions
All content accessible on Profiting, including interfaces, data structures, texts, classifications, AI-generated analyses, graphics, images, brands, algorithms, visual elements, source code or pseudocode, and their arrangement, is protected by intellectual and industrial property rights owned by PROFITING OÜ or its licensors.
It is strictly prohibited, without written and express authorization from PROFITING OÜ:
- To reproduce, copy, modify, distribute, publicly communicate, translate, adapt, or transform totally or partially the content or interface of the application, by any means or format.
- To reuse or resell information, analysis, or results obtained, even if they have been modified or transformed.
- To use content generated through a personal license for unauthorized business, institutional, or commercial purposes.
- To assign, sublicense, or share access to the account, results, or Profiteroles with third parties.
- To perform reverse engineering, decompilation, extraction, or automated scraping of data or results.
- To use the content of the application to create or feed similar or competing tools or services, directly or indirectly.
- To store, distribute, or reproduce analysis or results outside the PROFITING environment for public, educational, or demonstration purposes without express authorization.
Failure to comply with these conditions may result in the immediate cancellation of the account, the revocation of the user license, and, where appropriate, civil or criminal legal actions.
8. Additional Legal Aspects
- Profiting OÜ declares to have protected its model under the figure of trade secret in accordance with European regulations and other applicable regulations.
- The user undertakes not to disclose or attempt to obtain confidential information regarding algorithms, models, internal logic of opportunity classification, or any other element considered a business secret.
- The company reserves the right to take legal action against infringements of intellectual property, unfair competition, or unauthorized use of the service.
- It is the user's responsibility to verify that the use of Profiting and the connection with third-party brokers is legal in their jurisdiction and to respect territorial or regulatory restrictions that may apply.
- The logos and brands shown in Profiting are the property of their respective owners and are used exclusively for informative identification purposes of the analyzed asset. Profiting maintains no commercial relationship with such entities.
